Terms of Service

These Terms of Service ("Terms") are an agreement between you and Aureum Consulting LLC, a Texas limited liability company doing business as Aureum Coaching ("Aureum," "we," "us"). They apply to this website, the Aureum client app, and all coaching, education and other services we provide by phone or in person (the "Services"). By using the Services, sending an inquiry, or paying for a program, you agree to these Terms, our Privacy Policy and our Health Disclaimer.

1. Who can use the Services

You must be at least 18 years old to buy or use the Services. By using them, you confirm that you are 18 or older. We do not knowingly offer the Services to, or collect information from, children under 13.

2. What we provide

Aureum provides fitness coaching, nutrition coaching, identity and accountability coaching, life coaching and wellness education. The Services are coaching and education only. They are not medical care, therapy, mental health treatment, dietetic or nutrition therapy, or any licensed professional service. Please read our Health Disclaimer.

3. Prices and payment

Current prices are listed on our Programs & Pricing page and include, for example: Wellness Education $149; Nutrition Plan $197; Identity Only $247; Guide $297; Life Coaching $497; Protocol $1,497 paid in full or $549 a month for 3 months; Protocol + Wellness Education $1,597; Aureum 24 $3,497 paid in full or $649 a month for 6 months; and Keep, priced on your consult. Prices are in U.S. dollars and may change, but a change never affects a program you have already paid for or a payment plan you have already signed.

• Payment, a signed intake and a signed waiver are required before any plan is written or any session starts.
• Payments are handled by our third-party payment processor. We do not store your full card number.
• You agree to give accurate billing information and to keep it current.

4. Monthly payment plans

Protocol ($549 a month for 3 months) and Aureum 24 ($649 a month for 6 months) can be paid on a monthly payment plan. A payment plan is the same fixed program paid over time. It is not a trial and not a subscription that you can stop early.

• The first payment is due before your plan is written. Each later payment is due on the same day of each following month until every payment is made.
• If you authorize automatic payments, your payment method will be charged on each due date for the remaining number of payments shown when you sign up. Charges stop on their own after the final payment.
• Once your plan is written, you owe every payment in the plan, even if you stop attending or stop using the Services.
• If a payment fails, we may pause delivery of coaching until the balance is paid. The amount owed does not change.

5. Subscriptions and auto-renewal (Keep)

• How to cancel: email orozco.orlando096@gmail.com or text 956-670-6760 with your name and the word "CANCEL KEEP". We will confirm in writing.
• Cancel at least 24 hours before your next billing date to avoid the next charge. Cancellation takes effect at the end of the month you have already paid for, and you keep your remaining calls in that month.
• We do not give partial refunds for a month that has already started.
• If we change the Keep price, we will tell you in writing at least 30 days before the new price applies, and you can cancel before then.

6. Cancellations and refunds

• Before your plan is written: you can cancel for a full refund by email or text.
• Once your plan is written, it cannot be canceled, and the program is non-refundable. On a payment plan, every remaining payment is still owed.
• Single sessions (such as Wellness Education) can be canceled for a refund up to 24 hours before the session. After that, the session counts as used.
• Used, missed or expired calls and sessions are not refunded.
• Refunds, when owed, go back to the original payment method.

7. Scheduling, missed calls and no pauses

• 24-hour notice. To move a call or session, give at least 24 hours' notice. With 24 hours' notice, a call can be moved once, within the same month.
• Missed calls count as used. A call or session missed without 24 hours' notice, or a no-show, counts as used. It is not made up, and missed weeks do not roll over.
• No pauses. Programs cannot be paused. Your program runs on its schedule, and payments continue on their schedule.
• If your check-in log is not in at least 24 hours before your call, the call is still held, but it covers one topic only.

8. $149 Wellness Education credit

When offered, the $149 Wellness Education credit (and any credit included with Protocol or Aureum 24) is a promotional credit toward Aureum Services only.

• The credit has no cash value. It cannot be exchanged for cash, refunded, sold or transferred.
• Details of what the credit applies to, and when it must be used, are given to you in writing when you receive it. If you cancel or receive a refund, any unused credit ends.

9. Wellness education and peptides

Wellness Education sessions, including any discussion of peptides, are general education only. Aureum does not sell, prescribe, supply, dose or administer peptides or any medication, and gives no dosing or sourcing advice. Any decision about a peptide or medication is between you and a licensed medical provider. We can connect you with a licensed provider at no extra charge; that provider is independent of Aureum and is responsible for their own care, fees and advice.

10. Your responsibilities

• Talk with your doctor before starting any exercise, diet or wellness change, and tell us about any health condition, injury, pregnancy or medication.
• Stop any activity that causes pain, dizziness or shortness of breath, and seek medical help when needed.
• Give accurate information and follow your plan at your own pace and risk.

11. Results

Results vary from person to person and depend on many things outside our control. We do not guarantee any specific result, such as weight loss or a change in body composition. Testimonials and photos are individual experiences, not promises.

12. Intellectual property

Plans, worksheets, logs, the client app, and website content are owned by Aureum and are for your personal use only. Please do not copy, resell or share them without our written permission.

13. Limitation of liability

To the fullest extent allowed by law: (a) the Services are provided "as is," without warranties of any kind, express or implied; (b) Aureum and its owner will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, illness or loss resulting from your exercise, diet or wellness choices; and (c) Aureum's total liability for any claim relating to the Services is limited to the amount you paid Aureum for the Services in the 3 months before the claim. Some laws do not allow certain limits, so some of these may not apply to you. Nothing here limits liability that cannot be limited by law, including for gross negligence or willful misconduct.

You agree to indemnify and hold Aureum harmless from claims arising from your breach of these Terms or your misuse of the Services. The signed waiver you complete at intake also applies.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Hidalgo County, Texas, and you and Aureum agree to that venue. Before filing any claim, please contact us so we can try to resolve it informally.

15. Changes and other terms

We may update these Terms. The "Last updated" date shows the latest version. Changes do not affect a program you have already paid for. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with your signed intake, waiver and any written program agreement, are the full agreement between you and Aureum.
